Terms of Service

Version 1.2 · Effective 2026-04-19

1. General provisions and operator

These Terms of Service (the “Terms”) govern the use of the Cancer3.AI website, available at cancer3.ai (the “Service”). The Service is operated by Cancer3.AI (the “Operator”). The Operator can be contacted at: admin@cancer3.ai.

The Service is a scientific, research, informational and educational platform dedicated to collecting and presenting publicly available information on cancer and current research findings in oncology.

Target audience of the Service. The Service is intended for: researchers, scientists, students and graduates of medical, biological and related disciplines, healthcare professionals, science popularisers, and persons with a scientific interest in oncology. The Service is NOT intended for patients in their capacity as patients, nor for their family members — persons seeking emotional support, advice about their own diagnosis, interpretation of their own test results, or consultation about treatment should use dedicated channels (their treating physician, a psycho-oncologist, patient-advocacy organisations, support helplines). A patient who uses the Service as a scientific observer or for self-education must follow the Service rules, in particular the prohibition on posting their own medical data (§ 5a).

Nature of the Discussion Groups. The Discussion Groups are scientific, research, educational and science-popularisation in character. They serve as a space for exchange of information and views between researchers and professionals on: publicly available research findings and medical publications, new reports from global oncology, methodology of clinical trials, clinical guidelines (ESMO, ASCO, NCCN, PTOK) discussed in general terms, epidemiology, prevention, diagnosis and therapy at a general level (population, clinical trials, guidelines), progress in medical technology, and research ethics, bioethics, and systemic health-policy questions. The Discussion Groups are NOT a forum for discussing the health of specific individuals — they are not for descriptions of one’s own diagnoses, test results, treatment history, dosing schedules, drug interactions, or therapeutic plans, and still less for discussing the health of third parties. The Discussion Groups neither provide nor replace medical advice and are not a patient-support channel.

The Service is a hobby, non-commercial, non-profit project. The Operator runs the Service solely for educational, informational and science-popularisation purposes. The Service is free of charge, carries no advertising, does not monetise User data, does not sell data to third parties, and does not constitute an economic activity within the meaning of Polish Civil Code Art. 43¹. Infrastructure costs are covered by the Operator personally. The Service may be shut down or restricted at any time — notice of permanent discontinuation will be given at least 30 days in advance.

2. Definitions

  • Service — the Cancer3.AI website and all of its features.
  • User — any person using the Service, whether logged in or not.
  • Account — the set of data tied to a User’s nickname enabling them to post content.
  • Discussion Group — a topical area of the Service intended for scientific, research and educational exchange between Users on oncology topics discussed in general terms (research, publications, guidelines, methodology) — it is not a forum for discussing the health of specific individuals.
  • Content — any textual information published on the Service by the Operator or Users.
  • GDPR — Regulation (EU) 2016/679 of 27 April 2016.

3. Acceptance of Terms

Use of the Service constitutes acceptance of these Terms. Creating an Account requires explicit, affirmative acceptance of the Terms and the Privacy Policy via the checkboxes on the registration form.

If the Terms change, logged-in Users will be notified of the new version; continued use of the Account requires accepting the new version.

4. Age requirement

Under Article 8 GDPR, the Service is intended for persons 16 years of age or older. Younger persons may use the Service only with the consent of a legal guardian.

By creating an Account, the User represents that they are at least 16 years old, or that a legal guardian has consented on their behalf.

5. MEDICAL DISCLAIMER — critical

Content published on the Service is for information and education purposes only. No Content on the Service — including disease descriptions, research findings, posts by other Users in discussion groups, or AI-generated notes — constitutes medical advice, a diagnosis, or a treatment recommendation.

If you have any symptoms, concerns, or health questions, consult a physician or another qualified health professional without delay.

In a life-threatening situation, call emergency services immediately (112 throughout the European Union).

Do not delay consulting a physician or discontinue treatment based on information obtained from the Service.

5a. PROHIBITION ON SHARING MEDICAL DATA AND OTHER SPECIAL-CATEGORY DATA (Art. 9 GDPR)

The Service is designed so that it does NOT process special-category data within the meaning of Art. 9(1) GDPR. Maintaining this status depends on Users refraining from sharing such data on the Service.

This prohibition rests on two independent grounds: (1) keeping the Service outside the scope of Art. 9 GDPR (special-category data) and (2) the scientific and research character of the Service defined in § 1 — the Service is intended for researchers, scientists and professionals, and the Discussion Groups are not a space for discussing the health of specific individuals or for patient support.

In Discussion Groups and Private Messages, Users are PROHIBITED from sharing:

  • health data — medical diagnoses (e.g. “breast cancer, stage III”), test results (blood work, MRI, biopsy, genetic tests), treatment regimens, medication doses, names of medications being taken, details of chemotherapy, radiotherapy or immunotherapy;
  • health data of third parties — information about the illness of a family member, friend, or anyone other than the User;
  • names of physicians, hospitals or clinics tied to a specific case (even anonymised);
  • genetic or biometric data;
  • data on racial or ethnic origin, religious or political beliefs, trade-union membership, sexual orientation, where combined with health-related context.

What is allowed. Users may share personal experiences in a general form, without disclosing specific medical data, e.g.: “I’ve been through a very difficult period”, “I’m looking for support”, “I feel alone in my illness”, “how do you cope with fear”. Discussion of publicly known topics is also permitted (scientific publications, public-health campaigns, aggregate statistics).

Consequences of breaching this prohibition:

  • The User bears full and sole responsibility for the voluntary disclosure of their own or someone else’s special-category data.
  • The Operator will remove the offending Content or Message promptly upon detection or notice — typically within 72 hours.
  • For serious or repeated breaches the Operator may suspend or delete the User’s Account.

The Service interface displays a reminder before each message or post is sent. Information on how the Service processes (or rather — does not process) Art. 9 GDPR data is in the Privacy Policy, §§ 3.4 and 12.

6. Privacy-first registration

The Service deliberately does not require and does not ask for personal data. Creating an Account only requires choosing a nickname and a password.

We ask that you do NOT use personal data as your nickname, including:

  • first name or surname (including identifying initials),
  • email address,
  • phone number,
  • national ID numbers, ID card numbers, or other official identifiers,
  • date of birth, home address,
  • any other information that can identify you as an individual.

The User bears full responsibility for any personal data they voluntarily disclose in their nickname or in the content of published messages, including information about themselves.

7. User Account

  • Each User may hold only one Account.
  • Sharing an Account with third parties is prohibited.
  • The password should be unique and not reused on other services.
  • The Operator may suspend or delete an Account in case of breach of these Terms, breach of law, or where a breach is reasonably suspected.
  • The User may request Account deletion at any time by emailing the Operator.

8. Rules for posting in Discussion Groups

The Discussion Groups are a space for scientific, research and educational exchange between Users (researchers, scientists, professionals, medical and biological-sciences students, science popularisers). Expected topics include:

  • discussion of scientific publications (with links to sources: PubMed, DOI, preprint servers),
  • methodology of clinical trials, oncology statistics, predictive models,
  • presentation and analysis of clinical guidelines (ESMO, ASCO, NCCN, PTOK) in general terms,
  • epidemiology, primary and secondary prevention, screening, incidence trends,
  • progress in diagnostic and therapeutic technology (general discussions, not individual patient cases),
  • research ethics, bioethics, systemic health-policy questions,
  • methodological and science-popularisation reflections.

By posting Content, the User agrees to follow the rules below. The following is prohibited:

  • Posting descriptions of one’s own health status, diagnoses, test results, treatment history or therapeutic plans — and likewise analogous data concerning third parties (see § 5a). The Discussion Groups are not a patient-support channel.
  • Giving medical advice, diagnoses, or treatment recommendations. Neither the Operator nor other Users are another User’s physician. Treatment advice must be obtained solely from qualified specialists.
  • Content that breaches Polish law or European Union law.
  • Content promoting unproven or harmful therapies, pseudo-medical methods, or supplements/remedies as substitutes for evidence-based treatment.
  • Advertising, marketing, affiliate links, promotion of commercial products or services.
  • Spam, bulk messaging, automated posting.
  • Hate speech, discrimination, threats, insults, cyberbullying.
  • Pornographic, graphic, violent or shocking content.
  • Infringement of copyright, related rights, or trademarks.
  • Invasion of the privacy of others (posting their data, photos or private messages).
  • Impersonating other persons, physicians, specialists, institutions, or the Operator.
  • Attempts to circumvent the Service’s security or interfere with its operation.
  • Automated collection of other Users’ data (scraping).

9. No liability for User-generated content

The Operator is not the author or publisher of Content posted by Users. The Operator is not liable for Content posted by Users, including its truthfulness, accuracy, legality, or any damages arising from reliance on it.

Responsibility for Content lies solely with its author. The Operator acts as a hosting service provider within the meaning of Directive 2000/31/EC on electronic commerce.

Notices of violations may be sent to admin@cancer3.ai. Upon receipt of a credible notice that Content is unlawful, the Operator will promptly disable access to that Content.

10. No liability for third-party content and external links

The Service may contain links to external websites, scientific publications, databases (e.g. PubMed, GLOBOCAN), and other third-party resources. The Operator is not liable for:

  • the content, availability or currency of external sites,
  • the privacy practices of external sites,
  • the security of external sites,
  • any damages arising from use of external sites.

Use of external links is at the User’s own risk.

11. AI-generated translations

The Service is bilingual (PL/EN). So that Content can be understood by Users of either language, the Service uses the Claude AI model operated by Anthropic PBC (USA) to automatically translate Content: posts and replies in the Discussion Groups and private messages. Translations are produced automatically at the moment the author publishes the Content.

What this means for the User. Every piece of Content a User sends (a post or a private message) is, at the moment of sending, passed by the Service to the Anthropic API in the US for translation. Before pressing “Send”, assume that the text of the message will immediately leave the European Economic Area (EEA). Because of this:

  • Do not include in Content any medical data, identity data, passwords, payment data, or any other data whose disclosure would be harmful to the User or to third parties (see § 5a — an unconditional prohibition on special-category data).
  • The § 5a prohibition applies to private messages too — private messages are not an end-to-end-encrypted channel and go through the same translation pipeline.

Legal bases and guarantees. The legal bases for processing by Anthropic are: performance of a contract for electronic services (Art. 6(1)(b) GDPR — bilingualism is an integral function of the Service) and User consent given by accepting the Privacy Policy at registration (Art. 6(1)(a) GDPR). Anthropic acts as a processor within the meaning of Art. 28 GDPR. Under the Anthropic API commercial terms:

  • data sent through the API is not used to train or fine-tune Anthropic models,
  • Anthropic applies a zero-retention policy for commercial API customers — request and response are not retained beyond the technical window required to serve the call,
  • transfer to the US relies on the EU Standard Contractual Clauses (European Commission Decision 2021/914), incorporated into the Anthropic Data Processing Addendum (DPA).

A full description of this processing (what is sent, what is not sent, retention, legal basis, transfer mechanism, role of Anthropic) is in the Privacy Policy, §§ 6 and 6a.1.

Translation quality. AI translations may contain errors, inaccuracies, or misinterpretations of context. The Content in its original language (the language in which the author wrote it) always takes precedence over the translation. The Operator is not liable for consequences of relying on AI translations.

12. Intellectual property

The layout, logo, interface source code, editorial work, database compilations, and informational Content produced by the Operator are the Operator’s property or are used under appropriate licenses.

Content posted by Users remains the property of its authors. By posting Content on the Service, the User grants the Operator a non-exclusive, royalty-free, worldwide, sublicensable license to store, display, translate, and archive that Content as necessary to operate the Service.

This license terminates upon deletion of the Content by the User or deletion of the User’s Account.

13. Service availability

The Service is provided “as is”. The Operator makes no warranty of uninterrupted availability, absence of errors, fitness for any particular purpose, or data security beyond what is stated in the Privacy Policy.

Availability may be limited by: maintenance, technical failures, failures of service providers (e.g. hosting by Render, AI provider Anthropic), attacks, or force majeure.

14. Force majeure

The Operator is not liable for non-performance or defective performance of obligations under these Terms caused by force majeure, including: natural disasters, war, cyberattacks, prolonged power outages, internet failures, failures of service providers, or decisions of public authorities.

15. Data loss and backups

Users should independently archive Content they consider important. The Operator performs backups as part of standard hosting procedures but does not guarantee full recoverability of data in the event of failure.

16. Limitation of liability

To the maximum extent permitted by Polish law and the law of the European Union, the Operator is not liable for:

  • damages arising from use of or inability to use the Service,
  • medical, financial, legal or life decisions taken by the User on the basis of Content published on the Service,
  • health consequences of relying on Service Content instead of consulting a physician,
  • indirect damages, lost profits, loss of reputation, loss of time,
  • acts or omissions of other Users,
  • damages arising from voluntary disclosure by the User of their own personal data in a nickname or Content,
  • damages arising from voluntary disclosure by the User of health data, medical data, or other special-category data (Art. 9 GDPR) in breach of § 5a,
  • damages arising from voluntary disclosure by the User of medical or other personal data of third parties,
  • damages arising from breach by the User of security practices (password sharing, weak passwords),
  • errors or inaccuracies in AI translations,
  • outdated statistical data presented on the Service (GLOBOCAN, WHO, PubMed data is current as of its retrieval),
  • content and availability of external sites linked to.

The above limitations do not apply to liability that cannot be excluded under mandatory law (in particular, liability for willful misconduct).

17. Account and content deletion

The User may request deletion of their Account at any time by emailing admin@cancer3.ai.

After deletion, Content the User posted in discussion groups may remain on the Service in anonymised form (the author is replaced with the label “Deleted account”) if removal would materially disrupt existing threads. The User may also request full deletion of such Content.

18. Changes to the Terms

The Operator reserves the right to change these Terms in case of: changes to Service functionality, changes in the law, or changes in third-party services (e.g. AI providers). Users will be notified of changes via the Service or by email at least 7 days before the new version takes effect.

Refusal to accept the new Terms means cessation of Account use.

19. Governing law and disputes

Matters not governed by these Terms are subject to Polish law, including the Civil Code, the Act on Providing Services by Electronic Means, the Consumer Rights Act, and the GDPR.

The Polish version of these Terms is the binding version. The English version is provided for convenience only.

Disputes arising from these Terms will be resolved by the common courts having jurisdiction over the Operator’s place of residence. Users who are consumers may also use out-of-court dispute resolution, including the EU ODR platform: https://ec.europa.eu/consumers/odr/.

20. Miscellaneous

If any provision of these Terms is held invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect.
